Generally as far as legality is concerned, for a road registered car you should not have the battery in the passenger compartment, which includes the back of a hatch. The reason for this is to prevent any acid spills or noxious gas emissions from the battery affecting the occupants.
If you are going to move the battery, expect poorer performance from the battery due to the longer cables which you will need to use, and keep in mind the higher risk of something going wrong and your battery +ve lead shorting out - when you install the cabling, do it very carefully, and protect it very well.
Having said all that, using a 'dry' type battery such as an Odyssey or an Optima is fairly safe, but make sure that it is very well secured and that the +ve terminal is protected from accidental short circuits. See other post in this 'electrical' forum for some umm, enthusiastic discussion on battery types, boot mounting, and correct cables to use.
Cheers,

Hey,
had the battery in the boot of a HG monaro that I used to own.
Mounted in a marine battery case,
Used 1 full length positive to the starter motor,
and the negative earthed to the rear chassis,
and an earth at the front from chassis rail to the mounting bolt on the starter motor,
worked a treat.
Legality not sure, but can be done without too much trouble.
Cheers
Chris.
edit,
bad typing.

Mazda MX5, some BMW, some Mercedes & Triumph Stag (to name a few) all have boot mounted batteries factory. Some cars have them under the back seat VW Merc. Some have a vent tube on the battery to atmosphere for fumes. Most dont.
